Lucy Mirando et al. v. Ticketmaster, LLC

Prevailed against the odds on behalf of Ticketmaster on a motion to compel individual arbitration in a consumer putative class action about Ticketmaster’s terms of service.

The plaintiffs alleged Ticketmaster acquired their personally identifiable information in violation of the Song-Beverly Credit Card Act in connection with the online purchase of tickets intended to be picked up at “Will Call.” Willenken moved on behalf of Ticketmaster to compel arbitration. After a court-ordered supplemental briefing and two hard-fought hearings on the motion, Willenken’s arguments carried the day, and the Court granted Ticketmaster’s motion and dismissed the putative class action.
