Video Case Alert: Warner Chappell Music, Inc. v. Nealy

In this two-minute video, Willenken partner Kenneth Trujillo-Jamison discusses a case before the U.S. Supreme Court about whether there is a time limitation on damages recoverable by certain plaintiffs in copyright infringement cases. The Court’s opinion in this case may be released soon.

In Warner Chappell Music, Inc. v. Nealy, the Supreme Court may resolve a split among the Courts of Appeals on whether a copyright plaintiff whose claims accrue under the discovery rule can recover damages for infringements that occurred more than three years before the lawsuit was filed, or whether they are limited to only three years of relief. Oral argument indicated that certain justices are interested in deciding a more fundamental issue: whether the discovery rule should apply to copyright infringement claims at all.
