Partner Kenneth Trujillo-Jamison authored a column titled “A Circuit Split in Copyright Law: Will the Supreme Court Resolve It?” The column was published in the March 13, 2023 edition of the Daily Journal, a legal publishing company headquartered in Los Angeles, California.
Kenneth’s article covers a deepening circuit split about whether damages for copyright infringements occurring more than three years before suing are recoverable when the claim accrues under the discovery rule. Given the split, plaintiffs seeking to recover for stale infringements have an incentive to file in the Ninth or Eleventh Circuits, and to avoid the Second Circuit, where such relief is barred.
