In Hunley v. Instagram, LLC, a group of photographers sued Instagram for copyright infringement, based on third-party websites’ embedding of their Instagram posts containing their photographs.
The Ninth Circuit confirmed that under its “server test” Instagram could not be held liable under that theory. But the opinion suggests the Ninth Circuit will soon have an opportunity to reconsider that test.
