Represented the nation’s largest gas utilities in the U.S. in a product liability suit alleging injuries following a gas explosion.
The Willenken team filed a motion for summary judgment on the basis of a lack of subject jurisdiction matter. The plaintiff had been injured in a gas explosion and claimed that our client should have replaced the pipe that leaked. Our client contended that the rate at which it replaced older pipe was at the discretion of the California Public Utilities Commission.
Faced with the threat that the entire case could be dismissed without any recovery, the plaintiff settled the case at a fraction of its original demand.
