Regional Home Pharmacy v. Nationwide Pharmacy Chain

Represented a nationwide pharmacy chain in a case in which a regional home pharmacy chain recently purchased contended that our client owed $1.5 million.

The plaintiff contended that our client did not meet its obligation to use “commercially reasonable efforts” to collect the receivables and therefore owed the $1.5 million that remained in the escrow fund.

In a five-day binding arbitration, the firm capitalized on the evidence it had gathered during discovery. The arbitrator found our arguments to be “compelling” and “dispositive,” and ordered that the entire balance of the escrow fund be returned to our client.
