Lumens Co., Ltd. v. GoEco LED LLC et al.

Obtained a $1 million victory and a total defense victory to $16 million in counterclaims for Lumens Co., Ltd. (“Lumens”).

Willenken represented Korea-based LED manufacturer Lumens in a breach of contract case against a distributor and subsequent counterclaims that went on for four grueling years of litigation. As the team prepared for trial, we filed motions in limine exposing a fatal flaw in the defendant’s case. After the Court ordered a simultaneous summary judgment briefing, Amelia Sargent deftly briefed the simultaneous motions, two rounds of supplemental briefing, and argued the motions at two hearings. The Court handed Lumens a total victory on all contested issues, adopting verbatim the reasoning in Lumens’ briefs and argument and disposing of the entire case.

The case was later appealed before the U.S. Court of Appeals for the Ninth Circuit. On Dec. 12, 2019, Amelia presented oral argument to the Ninth Circuit on behalf of Lumens in Pasadena, Calif. On Feb. 24, 2020, the Ninth Circuit issued a memorandum disposition rejecting GoEco’s arguments and affirming Lumens’ victory.
