Watch Kenneth Trujillo-Jamison’s short video on an important copyright case that the U.S. Supreme Court agreed to review and will decide next term.
In Unicolors v. H&M Hennes & Mauritz L.P., the Court will resolve a split of authority among the courts of appeals on an issue related to copyright invalidation: When an applicant knowingly provides inaccurate information to the Copyright Office based on a mistake of law, is that a basis for invalidating the copyright?
This case may have significant impact because copyright registration applications are routinely filled out by artists, authors, and other non-lawyers who may be confused or misinformed of the legal requirements applicable to the information they provide in their copyright applications.
