On May 10, 2023, Willenken partner Kenneth Trujillo-Jamison moderated a panel for the Los Angeles Copyright Society, titled “In the Wake of Raging Bull: A Growing Circuit Split Since Petrella v. MGM.”

The panel discussed the 2014 Petrella v. MGM case in which the Supreme Court decided that laches did not bar a copyright claim brought within three years of infringement. The speakers also talked about the legal and practical impacts of this decision, including the deepening circuit split that followed and may make its way to the Supreme Court.

Kenneth recently authored a Daily Journal column on this topic, titled “A Circuit Split in Copyright Law: Will the Supreme Court Resolve It?” In the article, Kenneth addresses the growing circuit split about whether damages for copyright infringements occurring more than three years before suing are recoverable.

Speakers:

  • Kenneth Trujillo-Jamison, partner, Willenken (moderator)
  • Jay Srinivasan, partner, Gibson, Dunn & Crutcher
  • Tyler Ochoa, professor, High Tech Law Institute of Santa Clara University School of Law
